Terms of Use

01Acceptance of terms

By accessing or using the LoyalFast platform, its APIs, SDKs, dashboard or any related service (collectively, the “Service”) provided by Aberkane Software House FZ-LLC (“the Company”, “we”, “our”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Service.

02Service description

LoyalFast is a SaaS platform that enables merchants to create, manage and distribute loyalty cards in Apple Wallet and Google Wallet via APIs and a web dashboard. The Service includes wallet card generation, template management, certificate storage, push notification delivery, webhook integrations and associated tools.

03Account registration

You must create an account to use the Service. You agree to:

• Provide accurate, current and complete registration information.
• Promptly maintain and update your account information.
• Keep your password and API keys confidential and secure.
• Accept responsibility for all activity under your account.
• Immediately notify us of any unauthorized use of your account.

04Organizations and access

The Service supports multi-user organizations with role-based access control. The account owner is responsible for managing member access and permissions. You are responsible for all actions taken by members you invite to your organization.

05API keys and security

The Service provides secret keys (sk_live_) and publishable keys (pk_live_). You agree to:

• Keep secret API keys confidential and never expose them in client-side code.
• Rotate keys immediately upon suspected compromise.
• Use publishable keys only in contexts appropriate for public exposure.

We are not responsible for unauthorized access resulting from failure to protect your credentials.

06Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe the intellectual property rights of any third party.
• Distribute malware, spam or misleading content via wallet cards.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to gain unauthorized access to the Service or its infrastructure.
• Interfere with or disrupt the integrity or performance of the Service.
• Circumvent usage limits, rate limits or access controls.
• Create wallet cards that violate Apple Wallet or Google Wallet guidelines.

07Intellectual property

The Service, including its software, APIs, documentation and branding, is owned by the Company and protected by intellectual property laws. You retain ownership of all content and data submitted via the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

08Fees and payment

Certain Service features require payment. Fees are described on our pricing page and may change with 30 days' notice. All fees are non-refundable unless otherwise stated. Failure to pay may result in suspension or termination of your account.

09Service availability

We strive to maintain high availability, without guaranteeing uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates or circumstances beyond our control. We are not responsible for losses resulting from Service unavailability.

10Data and privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use and protect your data.

11Third-party services

The Service integrates with third-party services, including Apple Wallet, Google Wallet and push notification services. We are not responsible for the availability, accuracy or practices of third-party services. Your use of third-party services is subject to their respective terms.

12Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account if you violate these Terms. Upon termination:

• Your access to the Service will cease immediately.
• We may delete your data after a reasonable retention period.
• Provisions that by their nature should survive termination will survive.

13Limitation of liability

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, data or business opportunities arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

14Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.

15Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees and agents from any claims, losses or damages (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

16Modifications

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page with a revised “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

17Governing law

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Any disputes shall be resolved before the courts of Dubai, UAE.
